General Terms and Conditions (GTC) for the online shop subsonic.at

Scope These general terms and conditions (GTC) apply to all orders placed by customers via the SUBSONIC online shop on the Shopify platform. The GTC regulate the contractual relationship between Wolfgang Hafele Getränkehandel GmbH and its customers.

Contractual partner The purchase contract is concluded with Wolfgang Hafele Getränkehandel GmbH, Ried 276a, 6531 Ried im Oberinntal, Austria. Spreadshirt is responsible for the production, shipping and returns of the goods.

Offer and conclusion of contract The presentation of the products in the online shop does not constitute a legally binding offer, but an invitation to order. By clicking the order button, the customer makes a binding offer to purchase the goods contained in the shopping cart. Confirmation of receipt of the order is sent by email immediately after the order has been sent and does not constitute acceptance of the contract. The purchase contract is only concluded when we accept the order by sending an order confirmation by email or by delivering the goods.

Prices and shipping costs All prices are final prices and include VAT. In addition to the prices stated, we charge shipping costs for delivery. The shipping costs are clearly communicated to the customer during the ordering process.

Terms of payment Payment can be made by credit card, PayPal or other payment methods offered in the online shop. The account will be debited immediately after the order has been completed.

Delivery The goods are delivered by Spreadshirt to the delivery address specified by the customer. The delivery time is approximately 5-10 working days, unless otherwise stated. Partial deliveries are permitted as long as they are reasonable for the customer.

Right of withdrawal Consumers have the right to withdraw from the contract within 14 days without giving any reason. The withdrawal period shall be 14 days from the day on which the customer or a third party other than the carrier designated by him takes possession of the last goods. To exercise the right of withdrawal, the customer must inform us of his decision to withdraw from the contract by means of an unambiguous declaration (e.g. a letter sent by post or email). The goods will be returned to Spreadshirt.

Consequences of cancellation If the customer cancels this contract, we will refund all payments that we have received from the customer, including delivery costs (with the exception of additional costs resulting from the fact that the customer has chosen a different type of delivery than the cheapest standard delivery offered by us), promptly and at the latest within 14 days from the day on which we received notification of the cancellation of this contract. For this refund, we will use the same means of payment that the customer used for the original transaction, unless something else was expressly agreed with the customer; under no circumstances will the customer be charged any fees for this refund. We may refuse to refund until we have received the goods back or until the customer has provided proof that he has returned the goods, whichever is earlier.

Warranty The statutory warranty rights apply. If the delivered goods are defective, the customer has the right to demand subsequent performance (remedy of the defect or replacement delivery). Spreadshirt can refuse the type of subsequent performance chosen by the customer if it is only possible at disproportionate costs.

Liability We are fully liable for damages resulting from injury to life, body or health that are based on an intentional or negligent breach of duty by us or a legal representative or vicarious agent. We are only liable for other damages in the event of an intentional or grossly negligent breach of duty.

Retention of title The delivered goods remain the property of Wolfgang Hafele Getränkehandel GmbH until full payment has been made.

Data protection We collect, process and use the customer's personal data only within the framework of the legal provisions. Further information can be found in SUBSONIC's data protection declaration.

Final provisions Should a provision of these terms and conditions be invalid, the remainder of the contract shall remain valid. The relevant statutory provisions shall apply in place of the invalid provision. Changes or additions to these terms and conditions must be made in writing.
